Terms & Conditions

1. Agreement

By accessing or using Awinbuy.com (the "Site" or "Platform"), creating an account, or signing in with Google or Facebook, you agree to these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, stop using the Platform.

We may ask you to confirm these Terms with a checkbox at registration, checkout, or a refund request. Those confirmations are part of this agreement. The Privacy Policy explains how we handle personal information, including Google user data.

2. Who may use Awinbuy

You must be at least 18 years old, and you must have reached the age of majority where you live if that age is higher than 18. Accounts for anyone under 18 are prohibited. You may use Awinbuy only for yourself or for a business you are authorized to bind.

3. Accounts

1. Give true, current, and complete information, and keep it updated.
2. You are responsible for your password and for every action under your account, including orders and messages.
3. Tell us at info@awinbuy.com if you believe someone else is using your account.
4. Buyer, buyer-and-seller, and vendor accounts are different roles. When a buyer lists an item for sale, the account may be treated as a selling account and these seller terms apply.

Google and Facebook sign-in

If you use Sign in with Google, you also authorize Google to share with us the basic account details described in the Privacy Policy: Google account identifier, name, email address, and profile picture. We use that data only to create and secure your Awinbuy account. Facebook sign-in works the same way for the profile fields Facebook shares after you approve them. You can stop using social sign-in by closing your Awinbuy account or by writing to us.

4. The marketplace

Awinbuy hosts independent sellers. A contract of sale is between you and the seller. Awinbuy provides the listing, checkout, payment routing, and return tools. Sellers are solely responsible for the accuracy of their titles, photos, prices, quantities, and descriptions.

Awinbuy may refuse, remove, or correct a listing, and may cancel an order, when we believe it violates these Terms, the law, or a payment-processor rule.

5. Orders, prices, and payment

1. Your order is an offer to buy the listed item. The sale becomes binding when the order is confirmed in your account or the seller ships the item, as shown on the order confirmation.
2. Prices, shipping charges, and taxes are shown before you place the order. You authorize us and our payment processors (Stripe, PayPal, and Apple Pay) to charge the method you select.
3. If a price or availability error is obvious, the seller or Awinbuy may cancel the order and refund the amount charged.
4. You are responsible for taxes displayed at checkout. Sellers are responsible for their own income and business taxes.
5. If a payment fails or a chargeback is filed, we may pause the order, reverse store credit, or suspend the account while the dispute is open. Contact info@awinbuy.com before opening a chargeback so we can try to resolve the order.

6. Shipping

Delivery dates are estimates. Risk of loss for a third-party sale passes as stated by the seller and the carrier, and in all cases when the item is delivered to the address you gave us. You must provide a deliverable address. Failed delivery caused by an incorrect address can be treated as delivered.

7. Returns and refunds

Items purchased on Awinbuy are returned to the seller, not to a general Awinbuy warehouse, unless the return instructions name a different address.

When a return is accepted

You may request a return within 30 days after the carrier marks the item delivered. If the item never arrives, request help within 30 days after the order date. A return is accepted when:

The item is defective, broken, or does not function as intended on arrival, or the item has visible damage, poor workmanship, or materially differs from its description.

A return for change of mind or buyer's remorse is available only when that seller's listing says so. The following are not returnable unless they arrive damaged, defective, or materially different from the description, and any hygiene seal is still intact where that applies: perishable goods, personalized or custom-made items, digital goods after access has been provided, intimate apparel and pierced jewelry, gift cards, and store credit. Vehicle returns follow the return terms printed on that vehicle listing. A seller may state additional limits on the listing, and those limits apply if they are lawful and were visible before you ordered.

How to return an item

1. Start the return in your Awinbuy account.
2. Ship the item to the seller return address shown in the return request.
3. The seller inspects the item and confirms receipt. Awinbuy then issues the refund.

Refund amount

The refund is 100% of the item purchase price. A service or restocking fee is charged only when the amount is shown to you before you confirm the return or refund. If no fee is shown, no fee is charged.

Return shipping

1. Prime members: Awinbuy pays the return shipping and provides a prepaid label.
2. Standard customers: you pay return shipping. That cost is not refunded.

How the refund is paid

You choose one of these methods when the return is approved. The choice is final once we process it.

1. Original payment method. Your bank or card issuer typically posts the credit in 3 to 7 business days after we submit it. That timing is controlled by the financial institution.
2. Awinbuy store credit, which is applied to your account balance when the refund is approved and can be used on a later purchase.

8. Prime

Prime is an optional membership. Prime members receive prepaid return shipping on eligible returns under section 7, plus any other benefits shown in the Prime offer at the time you join. The price, billing period, and renewal date are shown before you subscribe and in your account. Prime continues for each billing period until you cancel. You may cancel in your account. Cancellation takes effect at the end of the period you already paid for. Starting a Prime subscription authorizes the recurring charge disclosed at sign-up.

9. Store credit

Store credit is a balance on your Awinbuy account. It is not cash, it is not transferable, and it cannot be redeemed for money except where the law requires a cash redemption. Store credit does not expire unless a shorter period is shown when the credit is issued. Credit issued because of fraud, or remaining on an account we close for a serious breach of these Terms, may be cancelled. If you close your own account, email us first if you still have a balance so we can apply it to an open order where that is possible.

10. Sellers and vendors

If you list or sell on Awinbuy, you agree that:

1. you are an independent seller, not an employee or agent of Awinbuy
2. every listing is accurate, lawful, and a product you have the right to sell
3. you will ship sold items as described, accept eligible returns, and inspect returned items promptly
4. fees, if any, are the fees shown in your seller account or on the fee schedule presented before you publish the listing. We will not add a fee that was not disclosed
5. payouts are released after delivery and after the return window and any payment-processor hold that applies to that order
6. you will pay your own taxes and follow consumer, product-safety, and advertising laws that apply to your goods
7. you will not charge a job applicant a fee to apply through Awinbuy

11. Dating and social features

When you use dating or social features, you will not:

Harass, bully, stalk, threaten, or intimidate anyone.

Post sexually explicit, hateful, or abusive content.

Solicit money, financial help, or run a financial scam.

Create a fake, impersonating, or bot profile.

Use the features if you are under 18, or contact anyone under 18.

We do not conduct criminal or identity background checks on members. You are responsible for your own safety in any meeting arranged through Awinbuy. Meet in public, tell someone you trust, and do not send money to another member. We may remove content or suspend an account that breaks these rules without advance notice.

12. Jobs

Job tools let employers post roles and let candidates apply. Awinbuy does not guarantee an interview, a response, or a job. Employers must post accurate descriptions and follow employment, wage, and anti-discrimination laws. Hiring decisions are made only by the employer.

13. Reels and entertainment

Entertainment content, software, graphics, and trademarks on Awinbuy are owned by Awinbuy or by our licensors. We grant you a limited, non-exclusive, non-transferable license to view that content for personal, non-commercial use. You may not download, copy, sell, or publicly perform it except through a control we provide, such as a share button.

14. Vehicles

Vehicle listings are offers by independent sellers unless the listing states that Awinbuy is the seller. Awinbuy does not inspect, title, or register the vehicle for you. Inspect the vehicle and confirm title before you pay any balance that is not already protected by checkout. Test drives and title transfer are arranged between the buyer and the seller.

15. Your content

You keep ownership of photos, listings, resumes, comments, and messages you submit. You grant Awinbuy a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content only as needed to operate, secure, and promote the specific feature you used (for example, showing a listing you published). You represent that you have the rights to submit the content and that it does not infringe anyone else's rights.

We may remove content that violates these Terms. The license ends when you delete the content and we finish removing it from public view, except for copies already shared with another user at your request, such as a job application sent to an employer, and backup copies kept for the periods in the Privacy Policy.

16. Acceptable use

You will not:

1. list or sell illegal goods, stolen goods, counterfeit goods, recalled products, controlled substances, or weapons where sale or shipment is unlawful
2. list hazardous materials that carriers cannot legally ship, or another person's personal data
3. use the Platform to commit fraud, phishing, or scams
4. scrape, probe, or overload the Site, or bypass access controls
5. upload malware or interfere with another account
6. use Awinbuy user data, including data obtained through Google sign-in, for advertising or to train a model

17. Intellectual property

The Awinbuy name, logos, and the software that runs the Platform are owned by Awinbuy or its licensors. These Terms do not transfer any of that ownership to you. You may not use our marks without written permission, except to name Awinbuy truthfully when describing your own listing or account.

18. Copyright complaints

If you believe content on Awinbuy infringes your copyright, email info@awinbuy.com with the subject line "Copyright notice" and include:

Your name, address, phone number, and email.

A description of the copyrighted work.

The URL or a clear description of where the material appears.

A statement that you have a good-faith belief the use is not authorized.

A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.

Your physical or electronic signature.

We may remove the material and, where appropriate, notify the account that posted it. We may suspend accounts that repeatedly infringe.

19. Disclaimers

The Platform, listings, dating and social features, job tools, reels, and vehicle listings are provided "as is" and "as available." To the fullest extent permitted by law, Awinbuy disclaims warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and disclaims any warranty that the service will be uninterrupted or error-free.

Sellers are responsible for their goods. Any product warranty is the seller's warranty, plus warranties that the law does not allow to be disclaimed. Awinbuy does not guarantee employment, a dating outcome, the condition of a vehicle, or the conduct of another user.

20. Limitation of liability

To the fullest extent permitted by law, Awinbuy and its owners, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from:

A transaction with an independent seller.

A meeting or message with another user.

A hiring decision by an employer.

A service interruption or loss of data.

Our total liability for a claim about a specific order is limited to the amount you paid for that order. Our total liability for any other claim is limited to the greater of one hundred U.S. dollars (US $100) or the fees you paid to Awinbuy for the service at issue during the three months before the claim.

These limits do not apply to liability that cannot be limited under applicable law, including liability for our own fraud or willful misconduct. Some states do not allow certain limitations, so parts of this section may not apply to you.

21. Indemnity

You will defend and indemnify Awinbuy and its owners, officers, employees, and agents against claims, damages, losses, and reasonable legal fees arising out of your content, your listings, your misuse of the Platform, or your breach of these Terms, except to the extent the claim is caused by our own fraud or willful misconduct.

22. Suspension and ending access

You may close your account by emailing info@awinbuy.com. We may suspend or close an account, or remove content, if you break these Terms, create risk for other users, or if we must do so to comply with law. Open orders remain in force. Sections that by their nature should survive, including returns on open orders, intellectual property, disclaimers, liability limits, indemnity, and dispute terms, stay in effect.

23. Disputes and governing law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-law rules. Courts in the State of Connecticut, and the federal courts located in Connecticut, have exclusive jurisdiction over disputes arising out of these Terms or the Platform, except that either party may bring an individual claim in small-claims court. Claims will be brought on an individual basis.

Before filing a lawsuit, email info@awinbuy.com with a short description of the dispute and give us 30 days to try to resolve it. This notice is not required for a request for injunctive relief against misuse of intellectual property or for an unauthorized account takeover.

24. Changes

We may update these Terms by posting the new version on this page with a new "Last updated" date. If a change materially reduces your rights on an existing order, the prior Terms apply to that order. Continued use after the new date constitutes acceptance of the updated Terms. If you do not agree, close your account.

25. Other terms

1. Electronic notices: you agree to receive agreements, disclosures, and notices electronically, including by email and by posting on the Site.
2. Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Awinbuy about the Platform and replace earlier oral or written statements on the same subject.
3. Severability: if one part of these Terms is unenforceable, the rest remains in effect.
4. Assignment: you may not assign these Terms. We may assign them as part of a merger, financing, or sale of the business.
5. Waiver: a failure to enforce a provision is not a waiver of it.
6. Force majeure: we are not liable for a delay caused by events outside our reasonable control, including carrier failures, payment network outages, natural disasters, war, and labor disputes.
